In Germany, you are not required to take out
legal protection insurance for real estate. However, you
should keep in mind that legal disputes involving real estate
can quickly become costly: If the tenant
doesn't pay the rent or the tax office
calculates the property tax incorrectly, enforcing your
rights can be expensive.
Examples: When does legal expenses insurance pay for real
estate?
Your property legal protection insurance will cover you in the
following cases:
- Neighbor disputes
- Trouble between tenants and landlords
- Incorrectly calculated taxes
In recent years, there has been an increase in
property disputes between neighbors, which has led to a
high workload in the courts. To relieve the burden on these
courts, in some federal states – including Bavaria, North
Rhine-Westphalia, and Schleswig-Holstein – you must first
attempt to resolve the dispute out of court. Only when
mediation or arbitration fails, you can take the case to
court.
What real estate legal protection does not cover
In some cases, real estate legal protection insurance won't help
you. These primarily include
disputes surrounding the financing and planning of
a new construction. This is often excluded in cases involving
the expropriation of residential property or land.

If a claim occurs, real estate legal protection covers the
following costs:
- Legal fees
- Court costs (e.g. witness fees)
- Costs for experts and assessors
- Fees of administrative authorities

The amount of court costs depends largely on the
tenancy disputes regarding termination, courts
generally set the Annual net rent.
